TERMS & CONDITIONS
By registering, bidding, or purchasing in this auction, you agree to these terms and all auction-specific and lot-specific notices.
1. BIDDING COMMITMENT
• All bids are binding and are a legal commitment to purchase.
• Bid responsibly and only on items you intend to pay for and pick up.
• Review all photos, descriptions, model numbers, quantities, and condition notes before bidding.
• Bids and winning purchases cannot be cancelled.
• Nova Trading Group LLC may restrict or block bidders who cancel, refuse payment, or otherwise fail to comply with these terms.
• All sales are final except as expressly stated below or required by applicable law.
2. BUYER’S PREMIUM, SALES TAX & PAYMENT
• A 16.5% buyer’s premium and applicable sales tax will be added to each winning bid.
• Tax exemption applies only when a valid resale certificate or other required documentation has been submitted and approved.
• Payment is processed automatically after the auction using the winning bidder’s payment method securely saved through Stripe.
• Nova Trading Group does not store full credit-card information.
• If automatic payment is unsuccessful, the bidder must resolve payment within 24 hours after the auction closes.
• Bidders are responsible for maintaining a valid payment method and sufficient available funds.
• Unresolved payment may result in item forfeiture, a 45% restocking fee, reporting to AuctionWorx, and restriction or permanent suspension from future auctions.
3. PICKUP POLICY
• Pickup is by appointment at Nova Trading Group LLC, 1240 Activity Dr, Suite A, Vista, CA 92081.
• Pickup must be scheduled within 48 hours of winning through the appointment link provided after the auction.
• All items must be collected within seven calendar days of winning unless Nova Trading Group approves other arrangements in advance.
• If you cannot attend your appointment, reschedule before the scheduled time using the provided link.
• Buyers must bring appropriate transportation, labor, tools, and packing materials.
• No-shows, failure to communicate, or failure to collect items may result in forfeiture, a 45% restocking fee, and account restrictions.
4. SHIPPING POLICY
• Shipping availability varies by lot.
• When shipping is available, cost is based on item weight, dimensions, packaging requirements, destination, and carrier rates.
• Shipping charges are separate from the auction invoice and must be paid before items are released.
• Bidders are responsible for considering potential shipping costs before bidding.
• Purchases cannot be cancelled because shipping costs are higher than expected.
• Nova Trading Group does not control carrier rates and cannot adjust those charges.
5. ITEM CONDITION & RETURNS
ALL ITEMS ARE SOLD AS IS, WHERE IS, WITH ALL FAULTS.
• Nova Trading Group is a liquidation company. Inventory may include customer returns, shelf pulls, overstock, open-box merchandise, packaging-damaged goods, and previously handled items.
• Items are generally not tested unless a listing specifically states otherwise. Nova Trading Group makes no guarantee regarding functionality, completeness, cosmetic condition, merchantability, or fitness for a particular purpose.
• Items may show use or damage and may be missing accessories, manuals, hardware, or parts.
• Assume any item may be a customer return or open-box item unless the lot specifically states otherwise.
• What is shown in the lot photos and expressly stated in the description is what the winning bidder will receive.
• Returns are considered only when the item received is substantially different from the item listed, such as an entirely different product.
• Returns are not accepted for an item that does not function as expected, missing parts or accessories, buyer’s remorse, or a change of mind.
• Any request that may qualify must be emailed to gilbert@novatrading-group.com within four days of pickup or delivery. Requests are reviewed individually, subject to applicable law.
6. PAYMENT DISPUTES & FRAUDULENT CLAIMS
• Contact Nova Trading Group promptly about any billing or merchandise concern and allow a reasonable opportunity to review it before initiating a payment dispute.
• Knowingly false claims or fraudulent chargebacks may result in account suspension, a permanent bidding ban, reporting to AuctionWorx, and legal action to recover losses where permitted by law.
• Nothing in these terms waives any right that cannot legally be waived.
7. FORFEITURE & ACCOUNT STATUS
Failure to pay, communicate, schedule pickup, or collect items within the required time may result in:
• Item forfeiture
• A 45% restocking fee
• Reporting to AuctionWorx for non-compliance
• Restriction or permanent suspension from future Nova Trading Group auctions
